1. Introduction to Everleads’ Services

Everleads is a trade name registered as a DBA (Doing Business As) under the Colorado corporation ListsOnline.com, Inc. (ListsOnline). ListsOnline is currently transitioning its database business to operate under the Everleads trade name. We may also conduct business as described on this website under the ListsOnline name/brand.

Everleads offers a range of data marketing and analytic services and products primarily focused on businesses, business contacts and professionals. These solutions help our clients, along with their platforms and partners, deliver more relevant marketing and gain deeper insights into their data.

This Privacy Policy covers Everleads, ListsOnline, and all affiliated entities, including additional DBAs as listed in the Entities Covered in this Privacy Policy section below. We provide this Privacy Policy as a service to consumers and others who want to learn more about the data we handle and how we use it.

2. The Types of Data That We Collect, Store and Use

Everleads’ focus is on business and professional data, not consumer data. We work with data that we obtain from public domain sources. These sources include state and federal government business and professional public record filings and registrations, public financial filings, public social network listings and public-facing websites. We also may obtain public domain data through third-party data compilers and suppliers.

Everleads primarily sources, stores and uses “publicly available” data which is:

  • Information that is lawfully made available from federal, state, or local government records; and

  • Information that is lawfully made available to the general public by the consumer or from widely distributed media.

Even when data is publicly available, we may still process requests and provide opt-out mechanisms as required by applicable law.

Some of the data we receive and use includes name, postal address, telephone number and/or email address. We also receive and use professional information, including occupation and job title. In addition, some of our services involve using and making available “business-to-business” (“B2B”) data, which is obtained from a number of sources, including government business filings and records, public domain directories, publications and third-party data suppliers.

This Privacy Policy addresses both information collected from the public domain sources described above and through this website. However, most of the information that we handle is not collected on this website. If you are particularly interested in the information we collect on this website, please see the Data Collected On Our Website section below.

3. Types of Data That We Do NOT Collect, Store or Use

Everleads does NOT collect, store or use sensitive data. “Sensitive data” (as defined in the Colorado Privacy Act C.R.S. §§ 6-1-1301) means the following:

(i) personal data revealing racial or ethnic origin, religious beliefs, a mental or physical health condition or diagnosis, sex life or sexual orientation, or citizenship or citizenship status;

(ii) genetic or biometric data that may be processed for the purpose of uniquely identifying an individual;

(iii) personal data from a known child; or,

(iv) biological data.

Everleads does not collect, store or use information about minors (individuals under 18 years of age).

Everleads does not collect, store or use commercial information related to personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Everleads does not collect, store or use biometric information related to genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, face-prints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

Everleads does not collect or use internet or other similar network activity for the purpose of behavioral profiling, except as described in the Data Collected On Our Website and Cookies and Similar Technologies sections below.

Everleads does not collect, store or use information related to geolocation data tracking an individual’s physical location or movements.

Everleads does not collect, store or use information related to sensory data which covers audio, electronic, visual, thermal, olfactory, or similar information.

Everleads does not collect, store or use non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). This refers to education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

Everleads does not create inferences for the purpose of profiling individuals based on behavior, preferences, or sensitive characteristics. Any professional classifications reflected in our databases are derived from publicly available source information and used solely for business-to-business data organization purposes. Everleads does not use inferences for consumer behavioral advertising, credit eligibility, housing, employment decisions, or other similarly sensitive purposes.

4. Our Services and How We Use Information

We provide information to authorized resellers and third-party businesses for marketing, sales, analytics and/or data management purposes. The intent of providing this information is to help marketers to deliver, target and optimize direct mail and email campaigns, display, mobile and social media marketing messages.

We may use information to help marketers and other data platforms perform “cross-channel” marketing – analyzing, locating and creating potential marketing “audiences” through multiple channels, e.g., web and mobile, or TV/radio.

Some of our customers, resellers, and platform partners may use de-identified identifiers (for example, a hashed email address or other identifier) within their own systems to help activate marketing audiences across channels (such as email, direct mail, or digital media). Those activities, including any use of cookies or similar online identifiers, occur on our customers’ or partners’ systems and are governed by their own privacy policies and opt-out mechanisms. Everleads does not use this website to retarget visitors across other websites.

Purpose of our Services. We provide these services to help increase the likelihood that marketers will send relevant and desired messages, rather than unwanted offers, content, coupons and ads.

5. How We Work With and Share Data With Third Parties

Everleads may disclose, share, or sell personal information as described below. For purposes of certain laws (including the CCPA/CPRA), “sell” may mean making personal information available to another business for valuable consideration, and “share” may mean making personal information available for cross-context behavioral advertising.

a. Service Providers: We may share data with service providers and/or business partners who work on our behalf, or to help us provide services requested by our customers, including to perform any of the services described in this Privacy Policy. We may share the data with these service providers in order to operate, protect and advertise our services. For instance, we may share the information with hosting providers, tech and customer support providers, or other data providers (to enhance or verify our data), and other companies that help us operate, improve or develop our services.

b. Partners: We may share or sell data with businesses and/or data partners (such as business partners who provide to marketers their own applications or data services) or with clients, to help provide more tailored advertising and for analytical purposes.

c. Third-Party Customers: We may share or sell data to third-party companies and services who provide their own data services. These customers include brands, agencies, marketing data companies and other data compilers that market and advertise to and on behalf of their own customers (and prospective customers).

d. Corporate Transfers: If Everleads or its significant assets are purchased by another entity, our data will likely be transferred to that entity, including for due diligence prior to any such potential purchase.

f. As Required by Law or to Protect Any Party: Everleads may disclose data if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) to protect or otherwise defend the rights, property or safety of Everleads or any other party.

g. Data We Collect on Our Website: We use data that you provide to us on our website for our business purposes primarily to follow up for sales and/or marketing Everleads products and/or services. For instance, if you provide us with your name and email address, we may put your information into our proprietary database and send you newsletters about our company, our services, and events. We will provide you a way to opt out of these emails, usually through a link in the email footer. You can also opt out of all communications by clicking here.

6. Data Collected On Our Website

This website is hosted by Squarespace (https://www.squarespace.com). We use this site primarily to provide information about Everleads and to receive inquiries.

a. Information you submit to us (Form Submissions). If you contact us through a form on this website, we collect the information you provide (such as name, email address, phone number, company, and message content). We use this information to respond to inquiries, provide requested information, and, if applicable, to follow up regarding Everleads’ products and services.

b. Information collected automatically (Hosting and Analytics). Like most websites, our hosting provider (Squarespace) and its systems may automatically collect certain device, usage, and log information when you visit our site to operate, secure, and maintain the website and generate analytics. This may include items such as IP address, browser type/version, device and operating system information, referring/exit pages, and pages or features viewed on our site, and it may involve cookies and/or similar technologies (including cookies necessary for site functionality and security). Because Squarespace Analytics is enabled, Squarespace may also use analytics/performance technologies to provide us with aggregate website traffic and usage metrics. We do not use this website data for cross-context behavioral advertising or retargeting.

7. Data Retention

We retain personal information for as long as reasonably necessary to: (i) maintain and improve the accuracy of our business and professional databases; (ii) provide our services; (iii) comply with legal obligations; (iv) prevent fraud and misuse; and (v) maintain suppression records reflecting opt-out, deletion, and “do not sell/share” requests.

Website contact and inquiry data is generally retained for up to 24 months after our last interaction with you, unless a longer period is required for legal, accounting, or security purposes.

Website log and device data (e.g., IP address, browser/device identifiers) is generally retained for up to 12 months.

Suppression records are retained as long as necessary to honor your request and prevent your information from being reintroduced into our marketing databases.

Squarespace, as our website hosting provider, uses cookies and similar technologies to help the website function and to help protect and secure the Services. b. Opting Out of Your Information Being Shared with Third Parties or Online Targeting: The steps described in Section 9(a) will opt you out of Everleads making your information available to third parties through our business and professional databases.

Separately, if you wish to limit interest-based advertising delivered by third parties on other websites or apps, you may use industry opt-out tools provided by the Network Advertising Initiative and the Digital Advertising Alliance (DAA) YourAdChoices program. Opting out through these services typically places one or more opt-out cookies on your browser or device. These opt-outs are generally browser/device-specific, so if you change browsers, clear cookies, or use a different device, you may need to opt out again.

These industry opt-out tools apply to participating advertising companies and are separate from Everleads’ opt-out mechanisms for our business and professional databases.

c. Global Privacy Control / Opt-Out Preference Signals. Some browsers and devices allow visitors to send an opt-out preference signal, such as the Global Privacy Control (GPC). We do not use this website for cross-context behavioral advertising or retargeting, and we do not sell or share personal information collected from this website for those purposes. Everleads primarily sources, stores and uses “publicly available” data as described by the State of California which is

Everleads follows CCPA guidelines regarding the management, storage and use of all Everleads data.

Everleads does not accept bulk privacy rights requests through unstructured channels. Requests must be submitted using Everleads’ designated privacy request mechanisms, unless otherwise coordinated in advance for security and operational purposes.

16. Residents of the European Union and United Kingdom

If you are located in the European Union/EEA or the United Kingdom, the GDPR and UK GDPR may provide you with rights regarding your personal information, including the right to request access, correction, deletion, restriction, and to object to certain processing.

Controller. For purposes of the GDPR/UK GDPR, ListsOnline.com, Inc. (d/b/a Everleads) is the data controller for personal information described in this Privacy Policy.

How we process website inquiry data. When you submit information through our website forms, we process that information to respond to your request and communicate with you. Our legal bases may include legitimate interests (responding to inquiries, operating and improving our business) and, where applicable, consent (for example, if you choose to receive marketing emails). We also use Squarespace Analytics to understand website usage in an aggregate manner.

How we process business and professional data. We also process business and professional contact information obtained from publicly available sources for business-to-business data marketing and analytics purposes.
